Are AI calling agents legal in India? What the rules say and what to check (2026)

Short answer: yes, an AI voice agent can lawfully phone people in India. There is no rule against a call being made by software. What matters is the kind of call, who you are calling, whether they agreed, and how you identify yourself. This is a plain-language guide to help you ask the right questions. It is not legal advice; speak to a lawyer about your own situation.

The rules that apply to any call, human or AI

  • TRAI's telemarketing rules (the Telecom Commercial Communications Customer Preference Regulations, amended most recently in February 2025) govern commercial calls and messages. They apply the same way whoever or whatever is dialling.
  • The National Do Not Disturb registry. People can opt out of promotional calls, by category. Promotional calls to a number on the registry are a problem; calls a customer asked for, such as answering their own enquiry, are treated differently from cold promotion.
  • Promotional versus service or transactional calls. TRAI treats these differently and uses different number series for them (reports describe 140-series numbers for promotional calls and 1600-series for service and transactional calls). Which one your call is decides which rules bind you.
  • DLT registration. Businesses making commercial calls register on TRAI's DLT platform, and telemarketing voice calls are now expected to run on it. Ask any vendor whether it is registered and whether you must register.
  • Hours. Promotional calling is commonly limited to 9 am to 9 pm; NaCaller's default calling window is the same, and you can only narrow it.

Rules specific to AI-generated voice

In February 2026 India's IT ministry amended the IT Rules to regulate ‘synthetically generated information’, including AI-generated audio, with labelling duties aimed mainly at platforms and intermediaries. The rules were reported as effective from 20 February 2026. How they apply to a business that uses an AI voice on its own calls is a point to take advice on. The safe habit, whatever the answer, is to say it is an AI in the opening line and never to claim to be a person.

Separately, the Digital Personal Data Protection Act, 2023 governs how you collect and use people's phone numbers and call data. Keep to what you need, and honour a request to stop.

What a responsible setup looks like

  • You call people who have a reason to expect it: a form they filled, a message they sent, a customer relationship. Not a purchased list.
  • The agent should say it is an AI in the opening line, and you should never script it to pretend to be a person.
  • Anyone who says ‘don't call me’ is never called again, on any campaign.
  • Calls stay inside sensible hours.
  • You keep a record: who was called, when, and what was said.

What NaCaller does, and what it leaves to you

What it does not do for you: decide whether your call is promotional or service, register you with TRAI's DLT platform, or check numbers against the national DND registry on your behalf. Those are questions for your compliance advisor and for whoever provides your calling numbers, and you should ask every vendor, us included, exactly what they cover.
